Exchange Meeting on Intellectual Property Rights Protection Achievements and New Trends of Infringement of Sichuan Province

    On the afternoon of September 5, the Exchange Meeting on Intellectual Property Rights (hereafter IPR) Protection Achievements and New Trends of Infringement of Sichuan Province was held in Chengdu. At the request of Quality Brands Protection Committee (hereafter QBPC), the exchange meeting gained vigorous support from the Sichuan Provincial Department of Public Security, Sichuan Provincial Department of Commerce, Sichuan Intellectual Property Office and other departments. More than 40 people attended the exchange meeting, including Captain Ke Qing and Vice Captain Li Zhigang of the Economic Crime Investigation Department (hereafter ECID) of Sichuan Provincial Department of Public Security; Director Qin Hu and Deputy Director Tang Jianxin of the Division of Command and Coordination; Deputy Director Yang Jun of the Division of Market Order of Sichuan Provincial Department of Commerce; Director Wang Junbo of Division of Legal Affairs of Sichuan Provincial Intellectual Property Office; Division Captain Zheng Lin and Team Captain Wei Yi of the Economic Crime Investigation Division of Chengdu Municipal Public Security Bureau, and Chairman Jack Chang, Vice Chairman Colin Chen as well as member companies’ representatives of QBPC.
    Chairman Jack said, in his opening remarks, that over the years, the work of QBPC has been vigorously supported by the ECID and relevant departments of Sichuan Province. Jack pointed out in particular that the Memorandum of Understanding (MOU) on Strengthening the Criminal Protection of IPR was signed between QBPC and the ECID of Sichuan Provincial Department of Public Security on November 5, 2008, and Director General Gao Feng, then Deputy Director General of the Economic Crime Investigation Bureau of the Ministry of Public Security (MPS) came to Sichuan to witness the cooperation of the two parties.
    Captain Ke of the ECID of Sichuan Provincial Department of Public Security expressed his thanks to QBPC for inviting him to participate in the professional exchange meeting on IPR protection. He briefed the participants on the work of IPR protection in Sichuan Province. Under the leadership of the provincial Party committee and provincial government of Sichuan Province, relevant departments have carried out various activities, deployed and coordinated by the Office of the Provincial Leading Group on the Fight against IPR Infringement and Counterfeiting and the Office of IPR Protection. The public security departments also take the fight against counterfeiting as the focus of their work and have investigated more than 2,000 cases of IPR infringement since 2013 including some major cases involving P&G, HP, Canon and many other member enterprises of QBPC. A large number of crimes of IPR infringement have been prevented, and the criminal gangs have been punished by law. More than 300 enterprises in the Fortune 500 have invested in Sichuan, many of them have set up the R & D center. The administrative law enforcement authorities and the criminal judicial authorities of Sichuan Province pay high attention and give rapid response to IPR cases of foreign-invested enterprises.
    The friendly exchanges between ECID of Sichuan Province and QBPC can trace back to 2002. After China’s accession to the WTO, a seminar on criminal IPR protection was held in Sichuan Province, and representatives including Chairman Jack Chang from more than 20 member companies of QBPC were invited. In 2008, Jack came to Chengdu city and signed the MOU on Strengthening the Criminal Protection of Intellectual Property Rights with the ECID of Sichuan Provincial Department of Public Security, indicating a closer cooperation between the two parties. Captain Ke said that the 2017 China Forum on Criminal IP Protection held in Hangzhou in June this year was very successful and praised the fruitful work of QBPC.
    Captain Ke also pointed out that counterfeiting and infringement have become a worldwide problem with the globalization of trade. He hoped that QBPC and the public security departments continue to main a close cooperation by intensifying information sharing and strengthening communication and coordination to jointly safeguard China’s good market order and protect the legitimate rights and interests of foreign-invested enterprises. He expected QBPC to continue to play an important role at home and abroad and to advertise the progress made by China in the IPR protection in the international community.
    Division Captain Zheng Lin of the Economic Crime Investigation Division of Chengdu Municipal Public Security Bureau said that the Economic Crime Investigation Division of Chengdu Municipal Public Security Bureau gives  full play to its function of serving and protecting the economic development, maintains the overall situation of the economic development, and cracks down on various economic crime activities, especially the economic crime cases of infringing on the rights and interests of foreign merchants,. They always maintain the high-pressure crackdown by taking the initiative to further optimize the foreign investment development environment and effectively serve the development of foreign enterprises.  Captain Zheng Lin introduced the work of the Economic Crime Investigation Division of Chengdu Municipal Public Security Bureau and some major cases cracked recently, covering many fields like auto parts, printing supplies and daily necessities, involving HP, Sharp, Toshiba, Canon, P&G, Mercedes-Benz, BMW, Gucci, Louis Vuitton and other international brands. He said that for the cases involving foreign-invested enterprises, the Economic Crime Investigation Division of Chengdu will continue to adhere to the principle of rapid acceptance, fast filing, rapid detection and rapid recovery of asset and damage, and resolutely protect the legitimate rights and interests of foreign-funded enterprises.
    Deputy Director Yang Jun of the Division of Market Order of Sichuan Provincial Department of Commerce introduced the organization structure and the working condition of the Office of Sichuan Provincial Leading Group on the Fight against IPR Infringement and Counterfeiting ( the Office hereafter) which was established in 2012 and now has 32 members. Coordinators hold a regular exchange meeting every year to supervise and inspect the work. Every year, in accordance with the requirements of the State Council, the annual work plan of Sichuan Province is made. In recent years, the Office carried out special actions, such as Internet sale of counterfeiting and infringement goods and the market management of the rural-urban fringe in rural areas. It strengthened cross-regional and cross-sectoral cooperation by establishing a cooperation mechanism with eight provinces and cities including Hainan and Guangdong, and joined the 2017 Silver Sword Alliance.
    Director Wang Junbo of Division of Legal Affairs of Sichuan Provincial Intellectual Property Office introduced the patent law enforcement work of Sichuan Provincial Intellectual Property Office. It revised the Standards of Sichuan Province for the Administrative Law Enforcement and Case-handling of Patent, further optimized and standardized the procedures for handling various patent cases. It issued the opinions on the implementation of a strict patent protection which require simplifying the procedures for accepting and hearing the case, improving the system and working mechanism of the strict patent protection and comprehensively enhancing the efficiency and level of the patent protection. Under the leadership of the Offices of National and Provincial Leading Group on the Fight against IPR Infringement and Counterfeiting, it carried out continuous law enforcement inspection for the key areas and links concerned by the masses and the society, actively carried out law enforcement work in emerging fields, and conducted law enforcement cooperation online and offline for counterfeiting and infringement in the field of e-commerce. It also set up an intellectual property office combining trademark, copyright and patent, and formed a law enforcement system containing one bureau, one team and one center.
    The exchange meeting was in a warm atmosphere and the participants expressed their opinions actively. After the self-introduction of QBPC members, Chairman Jack Chang declared the start of interactive sessions. Taking the brand Victoria’s Secret as an example, Jack put forward some businesses’ decoration design and pattern color of the business place or even packaging paper bags are exactly the same or have imperceptible differences, which is very easy to mislead consumers. Chairman Chuck Qi of the Customs Committee introduced the new challenges of the counterfeit registered trademarks and the price identification of the conterfeiting goods, He also expressed the possible challenges presented by the pilots of a lighter conviction or punishment for investigating the criminal liability of those who produce and sell counterfeits. The participants also discussed the software legalization, the sales of counterfeits on the Internet or in the WeChat group, the protection of technology secrets, the counterfeit goods of China Food & Drinks Fair and other issues.
    In the end, Jack highly praised the work of IPR protection in Sichuan Province and expressed his thanks to ECID and the relevant departments of Sichuan Province for their support for the work of QBPC. He said that QBPC will uphold the principle of win-win cooperation and play its role as a bridge. Captain Ke welcomed QBPC’s member companies and the agencies to reflect, directly or through the channels of QBPC, the problems or case clues encountered to the ECID of Sichuan Province. The ECID will provide assistance and coordination for the matters within the scope of its duties to protect the legitimate rights and interests of right holders according to law.
